1. Acceptance of Terms
By downloading, installing, or using Turning Pages ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Turning Pages ("we," "us," or "our").
2. Description of Service
Turning Pages is a personal book companion application available for iOS and macOS that allows users to track their reading activity, manage their personal book library, and view reading statistics including weekly, monthly, and annual summaries. The App is designed for personal, non-commercial use.
3. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.
4. User Accounts and Data
The App may use your Apple ID and iCloud account to sync your reading data across your devices. You are responsible for maintaining the security of your Apple ID and any activity that occurs under your account. We do not create or manage separate user accounts for the App.
5. User Content
You retain ownership of all content you create within the App, including book lists, reading notes, reviews, ratings, and any other personal data you enter ("User Content"). By using the App, you grant us a limited license to store and process your User Content solely for the purpose of providing and improving the App's services to you.
You are solely responsible for your User Content. You agree not to enter any content that is unlawful, infringing, or otherwise objectionable.
6. Subscriptions and Purchases
The App may offer a free tier with basic functionality and optional premium features available through in-app purchases or subscriptions ("Premium Features"). All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions.
- Subscription payments are charged to your Apple ID account upon confirmation of purchase.
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
- You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
- Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
Refunds are handled by Apple in accordance with their refund policies. We do not process refunds directly.
7. Acceptable Use
You agree to use the App only for its intended purpose and in compliance with all applicable laws and regulations. You agree not to:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
- Modify, adapt, translate, or create derivative works based on the App.
- Use the App for any commercial purpose without our prior written consent.
- Attempt to circumvent any security features or access restrictions of the App.
- Use the App in any manner that could damage, disable, overburden, or impair our servers or networks.
- Use automated systems or software to extract data from the App ("scraping").
8. Intellectual Property
The App, including its design, features, graphics, code, and all related intellectual property, is owned by Turning Pages and is protected by copyright, trademark, and other intellectual property laws. Book cover images, titles, author names, and other bibliographic data displayed within the App may be provided by third-party sources and remain the property of their respective owners.
The Turning Pages name, logo, and all related trademarks are the property of Turning Pages. You may not use any of our trademarks without our prior written permission.
9. Third-Party Services
The App may integrate with or rely on third-party services, including but not limited to Apple's iCloud for data synchronization, book data APIs for bibliographic information, and the Apple App Store for purchases. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party services.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not guarantee the accuracy or completeness of any book data, metadata, or bibliographic information displayed within the App.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TURNING PAGES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50.00, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify, defend, and hold harmless Turning Pages and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms.
13. Termination
We may terminate or suspend your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. You may terminate your use of the App at any time by deleting it from your devices.
Sections relating to Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law shall survive any termination of these Terms.
14. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located within the United States.
16. Apple-Specific Terms
These Terms are between you and Turning Pages only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, consumer protection claims, intellectual property claims, or any claim that the App fails to conform to any applicable legal or regulatory requirement.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
